Terms of Service

These Terms of Service apply to Better With Anna, TheBetterPlate, betterwithanna.health, blog.betterwithanna.health, app.betterwithanna.health and the TheBetterPlate iOS and Android applications (together, the “Services”).

2) Eligibility

You must be at least 16 years old to use the Services. If the law in your country requires a higher minimum age, that higher age applies.

3) The Services

The Services provide educational and lifestyle content related to nutrition, habits, movement, wellbeing and everyday decisions.

This may include blog posts, newsletters, menus, guides, lifestyle coaching, individual consultations, group programs or marathons, community formats, and app features such as menu scanning, OCR recognition and recommendations.

Service features may be changed, expanded, restricted or removed at any time.

4) Accounts, security and responsibility

If an account is required, you are responsible for providing accurate information, keeping your credentials safe and preventing unauthorized use. You are responsible for actions taken through your account or in connection with your use of the Services.

5) Lifestyle coaching – no medical advice

The Services provide lifestyle coaching and general educational information.

The Services do not provide medical advice, diagnosis or treatment.

Use of the Services does not create a doctor-patient relationship or other medical treatment relationship.

Recommendations on nutrition, movement, fasting, sleep, stress or lifestyle are for general guidance only. Before making significant changes to your diet, training routine or other health-relevant habits, you should consult a doctor or other qualified professional.

6) Programs, consultations and group formats

Consultations, programs, menus, marathons and community formats are intended for motivation, education and general support. They do not replace individualized medical advice, therapy or clinical nutrition therapy. Participants should not share sensitive personal or medical information in group chats, comments or public areas.

7) Personal responsibility

You are responsible for choosing your foods and products, checking ingredients, allergens and tolerances, adapting general recommendations to your personal situation, and complying with legal rules and venue policies when photographing menus or meals.

8) Uploaded photos and scans

If you upload photos (for example of menus or meals), you confirm that you are entitled to do so and that you do not violate third-party rights. Photos may be processed for analysis, OCR and app functions and then deleted in accordance with the Privacy Policy.

9) Location and price data

If you enable the “Save location and prices” function, GPS location data and menu prices may be processed. This feature is used to create anonymized price statistics and local recommendations. Restaurant names are not intentionally stored.

10) Acceptable use

You may not upload illegal or harmful content, violate third-party rights, manipulate, disrupt or abuse the Services technically, or use the Services for unlawful purposes. Access may be suspended or terminated in the event of violations.

11) Intellectual property

All content of the Services – including texts, logos, designs, programs, menus, guides and other materials – is protected by copyright and/or trademark law. Distribution, reproduction, public use or commercial use without permission is not allowed unless otherwise permitted by law.

12) Limitation of liability

The Services are provided “as available.” We do not guarantee complete availability, uninterrupted operation or absolute accuracy of all content, functions and recommendations. To the extent permitted by law, Better With Anna and TheBetterPlate are not liable for indirect damages, data loss, lost profits or consequential damages.

13) Changes to these Terms

These Terms may be updated from time to time. Continued use of the Services after publication of an updated version constitutes acceptance of the updated Terms to the extent legally permissible.

14) Governing law and jurisdiction

For users outside Russia, Austrian law applies and Vienna is the place of jurisdiction, subject to mandatory consumer law. For users in Russia, Russian law applies and Kemerovo is the place of jurisdiction, subject to mandatory law.

Country of residence and accuracy of data

On registration the User must provide their true country of permanent residence. The authorization method, the way access to materials is provided, and the applicable legal and tax conditions are determined on the basis of the country of residence declared by the User. The User confirms that the information provided (including country of residence, contact and billing details) is accurate and up to date. If the User declares a false country of residence or other false data — including in order to circumvent restrictions or requirements applicable to their actual country — the User bears sole responsibility for such conduct and its legal consequences and indemnifies and holds the Operator harmless from any claims, demands or losses arising from the provision of inaccurate information.
